DeSisto Law is currently representing the City of Cranston, Rhode Island before the United States Supreme Court. A Cranston resident brought suit against the City and several of its police officers in 2015 after he was transported by ambulance to a nearby hospital for a psychological evaluation and two firearms were seized from his home. The resident challenged these actions as violative of his Fourth Amendment rights. In 2019, DeSisto Law successfully obtained summary judgment in the matter from the United States District Court for the District of Rhode Island, after arguing that the officers lawfully performed their community caretaking function. The United States Court of Appeals for the First Circuit then affirmed on the same grounds in 2020. The matter now proceeds to the US Supreme Court, with oral arguments expected in March 2021.
